Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of all products, platforms, and services provided by Parsec Education, Inc. and its wholly-owned subsidiaries (collectively, “Parsec”), including but not limited to: (a) Real, ParsecReel’s Web App, Mobile App, and Desktop App for student and staff feedback, communication, and insights; (b) Parsec Education’s analytics Dashboard, including all tiers thereof (whether free or paid); and (c) Parsec Academy’s Web App for educator training and professional development (collectively, the “Services”). This AUP applies to all users of the Services, including Institutional Clients, their Authorized Users, and Authorized Free Tier Users, regardless of account type or tier.
Parsec is committed to maintaining a secure, reliable, and lawful platform. The following categories of conduct and content are prohibited on all Services. Violation of this AUP may result in the consequences described in Section B below.
A. Unacceptable Use
1) Privacy: Do not violate the privacy rights of any person. Do not collect or disclose any personal address, social security number, or other personally identifiable information without each holder’s written permission. Do not contact any person who has requested no further contact. Do not cooperate in or facilitate identity theft.
2) Intellectual Property: Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not reproduce, publish, or disseminate software, audio recordings, video recordings, photographs, articles, or other works of authorship without the written permission of the copyright holder.
Without limiting the foregoing, users may not reproduce, copy, distribute, or create derivative works from any Parsec proprietary content, including but not limited to data compilations, visualizations, analytical outputs, report formats, user interface designs, or software, except as expressly permitted under the applicable account tier and the Terms of Service.
3) Hacking, Viruses, & Network Attacks: Do not access any computer or communications system without authorization, including the computers used to provide the Service. Do not attempt to penetrate or disable any security system. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website associated with the Service. Do not attempt to access or otherwise interfere with the accounts of other users of the Service.
Do not circumvent, disable, or otherwise interfere with security-related features, access controls, or usage-limiting features of the Services. This includes, but is not limited to, using automated scripts, bots, or tools to bypass query rate limits, data export restrictions, view limitations, or any other resource constraints applicable to your account tier. Do not create multiple accounts using different identities, email addresses, or credentials to evade usage limitations, access restrictions, or account termination.
Do not use any robot, spider, crawler, scraper, data mining tool, or any other automated means to access, collect, index, download, parse, or extract any data, content, or information from the Services, whether for personal, commercial, or any other purpose. Manual access and use of the Services in accordance with the applicable account tier and the Terms of Service is permitted; systematic or programmatic access is not, unless Parsec has provided explicit prior written authorization.
Do not register for or access the Services using automated account creation tools, bot networks, or any mechanism designed to generate accounts without genuine individual human registration.
4) Spam: Do not send bulk unsolicited e-mails (“Spam”) or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.
5) Fraud: Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
Do not register for an account using false, misleading, or fraudulent identity information, organizational affiliations, or professional credentials. Do not misrepresent your purpose for accessing the Services or your relationship to any Educational Institution or other organization.
6) Violations of Law: Do not violate any applicable laws.
7) Disallowed Content & Conduct: Do not upload, download, transmit, display, or grant access to content that:
(a) Is illegal or promotes illegal activities.
(b) Is inappropriate, such as obscene or pornographic materials, graphic depictions of sexuality or violence, or images that exploit or harm children.
(c) Infringes anyone’s rights, including intellectual property or other proprietary rights or rights of privacy or publicity.
(d) Is false or fraudulent or is designed to phish or perform other identity theft.
(e) Is intended to promote gambling.
(f) Engages in the advertisement of or encourages illegal or controlled products or services.
(g) Is a realistic call to violence. By that we mean that you cannot submit content which threatens, incites, or promotes violence, physical harm, or death. This includes threats targeting individuals or groups, as well as other indiscriminate acts of violence.
In addition to the content prohibitions above, the following conduct is prohibited across all Services:
Competitive Use. Do not access or use the Services, directly or indirectly, on behalf of or for the benefit of any entity that competes with Parsec in the provision of educational data analytics, student information systems, assessment platforms, or related products or services. Do not use access to the Services to benchmark, evaluate, reverse engineer, or inform the development of any competing product or service.
Analytical Replication. Do not analyze, deconstruct, or reverse engineer the data models, compilation methodologies, aggregation logic, analytical frameworks, or proprietary data structures accessible through the Services for the purpose of replicating or approximating Parsec’s proprietary analytical outputs or product functionality.
Unauthorized Commercialization. If you are accessing the Services under a Free Tier Account, you may not sell, rent, license, publish for commercial purposes, or otherwise commercially redistribute or exploit any reports, charts, data visualizations, compiled datasets, analytical summaries, or other outputs generated by or accessed through the Services without Parsec’s prior written consent. Commercial use of Service outputs by Institutional Clients is governed by the applicable Service Order and Terms of Service.
IMPORTANT NOTICE REGARDING REAL: Real’s feedback features are not intended to be used to report incidents, emergencies, or safety concerns. Please refer to your organization’s policies and designated channels for reporting incidents. This notice applies solely to Real’s Web App, Mobile App, and Desktop App and does not apply to Parsec Education’s analytics Dashboard or Parsec Academy.
B. Consequences of Violation
Parsec reserves the right, in its sole discretion, to take any or all of the following actions, individually or in combination, in response to any violation or suspected violation of this AUP, without liability to the user:
(a) Warning. Parsec may issue a written or electronic warning to the user identifying the violation and requesting corrective action.
(b) Throttling and Restriction. Parsec may throttle, limit, or restrict the user’s access to specific features, data, or functionality of the Services, including reducing query limits, disabling data exports, or limiting page views.
(c) Temporary Suspension. Parsec may temporarily suspend the user’s access to the Services for a specified period, with or without notice, pending investigation or resolution of the suspected violation.
(d) Account Termination. Parsec may permanently terminate the user’s account and all access to the Services, with or without notice. For Institutional Clients, termination of access is subject to the applicable provisions of the Terms of Service.
(e) Legal Action. Parsec may pursue any available legal remedies, including injunctive relief, damages, and recovery of attorneys’ fees and investigation costs.
Parsec is not required to follow any particular sequence of enforcement actions and may proceed directly to any remedy it deems appropriate under the circumstances, including immediate termination without prior warning for severe violations. The selection of a particular enforcement action in one instance does not obligate Parsec to follow the same approach in any other instance. Neither this AUP nor the Terms of Service requires Parsec to take any action against any user for violating this AUP, but Parsec is free to take any action it sees fit.
C. Reporting Violations
Parsec requests that anyone with information about a violation of this AUP report it via email to privacy@parseceducation.com. Please provide the date and time (with time zone) of the violation, any identifying information regarding the violator (including email or IP address if available), the specific Service involved, and details of the violation.
D. Revision of AUP
Parsec may revise this AUP at any time by posting an updated version at its website. For revisions that do not materially expand the obligations of or materially reduce the rights of users, the updated version will become effective upon posting. For revisions that materially expand user obligations or materially reduce user rights, Parsec will provide notice in accordance with the Terms of Service, and such revisions will become effective as provided therein. Continued use of the Services after any revision becomes effective constitutes acceptance of the revised AUP.
